Terms and Conditions for Teacher Buddy

These Terms and Conditions ("Terms") govern your use of the Teacher Buddy mobile application (the "App"), developed by Pickerry LLC ("we," "our," or "us").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not download, install, or use the App.
1. Description of Service
Teacher Buddy is a local-first mobile productivity utility designed to help classroom teachers and educators organize and track:
- Classroom list and student profiles
- Attendance histories (present, absent, late)
- Academic achievements, homework, and exam grades
- Student behaviors and daily activity logs
- General student fee records and book checkout logs
All data is stored directly on the user’s device and is not collected or stored on our servers.
2. Eligibility and License
- Target Audience: The App is intended for use by adult educators, teachers, and school administrators (18 years of age or older).
- License Grant: We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your mobile device for personal or professional classroom management purposes.
3. Data Storage and User Responsibility
A. Offline-First Architecture
- No Server Recovery: Teacher Buddy is an offline-first app. All information you input is stored in a local database on your device. We do not have access to your data.
- Risk of Data Loss: If your device is lost, stolen, damaged, formatted, or if you uninstall the App without creating a backup, all your data will be permanently lost. We cannot recover your data under any circumstances.
- Backup Responsibility: You are solely responsible for creating and maintaining regular backups of your data. You may use the built-in local backup feature (to copy files to your device's downloads/external directory) or the Google Drive integration.
B. Google Drive Backup Integration
- Integration: The App offers an optional backup service using the Google Drive API. Enabling this feature connects your Google account to the App.
- Credentials: We never access, store, or receive your Google account password. Authentication is processed securely via Google OAuth.
- Account Security: You are responsible for maintaining the security and confidentiality of your Google account credentials. We are not liable for any unauthorized access to your Google Drive account or the backup files stored therein.
4. Compliance with Student Privacy Laws (e.g., COPPA, GDPR, FERPA)
As a teacher or school administrator, you may enter data pertaining to students, including minors.
- Your Responsibility: You are solely responsible for ensuring that your use of the App and entry of student data complies with all applicable national, state, and local student privacy laws and regulations (e.g., COPPA in the United States, FERPA, GDPR in the European Union).
- Consent: You warrant that you have obtained all necessary authorizations and consents from your school, school district, parents, or legal guardians before inputting student details, contact numbers, grades, fees, or student photos into the App.
5. Prohibited Conduct
You agree not to:
- Use the App for any illegal, unauthorized, or commercial redistribution purposes.
- Reverse engineer, decompile, modify, or attempt to extract the source code of the App.
- Upload corrupted zip archives or tamper with the Google Drive synchronization mechanisms.
- Enter fraudulent or unlawful data into the App.
6. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT warrant that:
- THE APP WILL RUN UNINTERRUPTED, BUG-FREE, OR ERROR-FREE.
- YOUR LOCAL OR GOOGLE DRIVE BACKUPS WILL ALWAYS BE SUCCESSFUL OR SECURE AGAINST STORAGE CORRUPTION.
- DATA RECOVERY FROM BACKUPS WILL BE 100% SUCCESSFUL.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, GOODWILL, WORK STOPPAGE, COMPUTER OR DEVICE FAILURE, OR ANY OTHER DAMAGE OR LOSS RESULTING FROM:
- YOUR USE OF OR INABILITY TO USE THE APP.
- THE LOSS OR CORRUPTION OF YOUR CLASSROOM OR STUDENT DATA.
- UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR GOOGLE DRIVE ACCOUNT.
8. Intellectual Property
All intellectual property rights in the App, including designs, icons, logos, source code, and assets, are owned by us or our licensors. You may not use our trademarks or copyrighted assets without our prior written consent.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law principles. Any legal actions arising under these Terms shall be resolved in the competent courts of Delaware.
